Clause 44

Section 13 of the Trade Marks Act is amended by inserting, immediately after subsection (4), the following subsection:“(5) In this section and sections 15, 16 and 17, a reference to an application for the registration of a trade mark that has been accepted includes an application that is accepted under section 12(4) or (4A) in relation to only some of the goods or services for which the registration is sought.”.

Section 13(5) of the Trade Marks Act, as inserted by subsection (1), is further amended by deleting “(4A)” and substituting “(5)”.
