Clause 51

Amendment of section 108

Section 108(2) of the Trade Marks Act is amended —

(a)

by inserting, immediately after paragraph (e), the following paragraph:“(ea)to enable the Registrar to publish —

(i)

an application to rectify an error or omission in the register; and

(ii)

a request to amend an application, a notice or other document,and to provide for the making of objections to the rectification or amendment by a person claiming to be affected by it;”;

(b)

by deleting the word “and” at the end of paragraph (i), and by inserting immediately thereafter the following paragraph:“(ia)for the continued processing of an application that is treated as withdrawn; and”; and

(c)

by deleting sub-paragraph (i) of paragraph (j).
