Clause 49

Administration of Act

(1)

It is the function of the Authority to administer this Act.

(2)

In performing the functions conferred on the Authority by this Act, the Authority must aim to strike what appears to the Authority to be an appropriate balance between —

(a)

the desirability of funding from the land betterment charge (in whole or in part) the actual and expected estimated total cost of infrastructure required to support the development of land as a result of a chargeable consent, taking into account other actual and expected sources of funding; and

(b)

the potential effects (taken as a whole) of the imposition of any land betterment charge on the economic viability of any development of land.

(3)

Before making any decision under section 20 or 22 in relation to a deferment determination, the Authority may consult with such person or committee of persons specified by the Minister but, in making such decision, the Authority is not bound by such consultation.
