Clause 39
When does relevant person knowingly permit another person to cause grievous hurt to or ill-treat child
For the purposes of section 37(1)(c) and (d) —
a relevant person knowingly permits another person (A) to cause grievous hurt to a child or to ill‑treat a child if the relevant person —
knows or has reason to believe that the child was at risk of being caused grievous hurt or being ill‑treated by A; and
failed to take such steps as the relevant person could reasonably have been expected in the relevant person’s circumstances to take to protect the child from that risk; and
the relevant person’s circumstances mentioned in paragraph (a)(ii) include but are not limited to his or her past or present experiences of being caused grievous hurt or being ill‑treated by A, if any.
