Clause 28

Amendment of section 45

Section 45 of the principal Act is amended —

(a)

by deleting the word “and” at the end of paragraph (e) of subsection (2), and by inserting immediately thereafter the following paragraphs:“(ea)the requirements to be complied with by persons involved in the provision of cruise port services and facilities, or in activities or events carried out at cruise terminals;

(eb)the procedure for any appeal to the Minister; and”; and

(b)

by deleting paragraph (b) of subsection (3) and substituting the following paragraph:“(b)may provide for the imposition of penalties for such offences as follows:

(i)

in the case of an offence for the contravention of any regulation made for the purposes of Part 3AA, a fine not exceeding $100,000 or imprisonment for a term not exceeding 6 months or both and, in the case of a continuing offence, a further fine not exceeding $1,000 for every day or part of a day during which the offence continues after conviction;

(ii)

in any other case, a fine of $5,000; and”.
