Clause 37

In section 75 of the principal Act, after subsection (2), insert —“(3) The Agency may grant the extension of time under subsection (2) after the time sought to be extended has expired, but only if the application by the person was made to the Agency before the expiry of the time sought to be extended.(4) Where subsection (3) applies, the Agency must extend the time to a date after the date of the decision of the Agency on the application and, to avoid doubt, time is treated as extended so long as the Agency has not made its decision.(5) The Agency may grant one or more extensions of time under and in accordance with this section.”.
