Clause 42

Amendment of Fifth Schedule

In the Fifth Schedule to the principal Act —

(a)

in paragraph 3(a), after “the form and manner in which”, insert “, and any person by whom,”;

(b)

in paragraph 3(a)(i), (ii) and (iii) and (b), delete “carbon credits” and substitute “fixed‑price carbon credits”;

(c)

in paragraph 3(a)(ii), delete “registry account” and substitute “FPCC registry account”;

(d)

in paragraph 3(a)(v), delete “a registry account” and substitute “an FPCC registry account or an ICC registry account”;

(e)

in paragraph 3(b), delete “and” at the end; and

(f)

in paragraph 3, after sub-paragraph (b), insert —“(ba)the criteria for eligible international carbon credits, and the acceptance by the Agency of eligible international carbon credits;

(bb)the time and manner in which or the process by which any eligible international carbon credit must be surrendered, and the circumstances in which any eligible international carbon credit may be treated as surrendered; and”.
