Clause 10

Amendment of section 37

Section 37 of the Accounting and Corporate Regulatory Authority Act 2004 is amended by deleting subsection (2) and substituting the following subsection:“(2) A person other than the Authority must not —

(a)

use, without the prior written permission of the Authority, the name of the Authority or the acronym ACRA; or

(b)

use a name or an acronym which so resembles the name of the Authority or the acronym ACRA as is likely to deceive or cause confusion —

(i)

in connection with a business, trade, profession or occupation;

(ii)

as the name, or as part of the name, of any firm, body corporate or institution; or

(iii)

in relation to —

(A)

services or products; or

(B)

the promotion, by any means, of the supply of services or products.”.
