Related amendments to Vulnerable Adults Act 2018
In the Vulnerable Adults Act 2018 —
in section 2(1), in the definition of “emotional or psychological abuse”, delete “towards another individual”;
in section 2(1), in the definition of “emotional or psychological abuse”, in paragraph (a), replace “is offensive to the other individual” with “distresses another individual”;
in section 2(1), in the definition of “emotional or psychological abuse”, in paragraph (b), replace “the other individual” with “another individual”;
in section 14(10)(a), replace “$5,000” with “$10,000”;
in section 14(10)(b), replace “$8,000” with “$10,000”;
in section 22(7), replace “The court may, in addition to any punishment mentioned in subsection (6),” with “In proceedings for an offence under subsection (6), the court may, whether or not there is a conviction for the offence,”;
in section 24(2)(a), replace “and” at the end with “or”;
in section 26(2)(d), delete “found in the premises mentioned in paragraph (a)”;
in section 28(5), delete “or a place of custody specified by the Minister,”; and
before section 30, insert —“Power to record, etc.29A.—
A relevant person may take photographs, or make an audio or video recording of any person, place or thing if the relevant person reasonably believes that the taking of the photographs or the making of the recording is relevant to and necessary for the exercise of the relevant person’s functions under this Act.(2) In this section, “relevant person” means the Director‑General, a protector, an approved welfare officer or an authorised officer.”.
