Amendment of section 144
In the principal Act, in section 144 —
in the section heading, replace “mental defective” with “woman with mental impairment”;
in subsections (1) and (2), replace “a woman who is a mental defective” with “a woman who has a mental impairment”;
in subsection (2), replace “be a mental defective” with “have a mental impairment”; and
after subsection (4), insert —“(5) In this section, “mental impairment” means an impairment of or a disturbance in the functioning of the mind or brain resulting from any disability or disorder of the mind or brain that impairs the ability to make a proper judgment in the giving of consent to sexual penetration.”.
