Amendment of section 11B
Section 11B of the principal Act is amended by deleting subsection (3) and substituting the following subsections:“(3) Subject to subsection (3A), a person who is guilty of an offence under subsection (1) or (2) shall on conviction be punished with imprisonment for a term not exceeding 10 years.(3A) If a person —
(a)
has a previous conviction under subsection (1) or (2) or section 11N(1) or (2); and
(b)
is convicted of an offence under subsection (1) or (2),that person shall on conviction be punished with imprisonment for a term of not less than 2 years and not more than 10 years.”.
