Amendment of section 11D

Section 11D of the principal Act is amended by deleting subsections (3) and (4) and substituting the following subsections:“(3) Subject to subsection (4), a person who is guilty of an offence under subsection (1) shall on conviction be punished with imprisonment for a term not exceeding 10 years.(4) If a person —

(a)

has a previous conviction under subsection (1) or section 11P(1); and

(b)

is convicted of an offence under subsection (1),that person shall on conviction be punished with imprisonment for a term of not less than 2 years and not more than 10 years.(4A) Subject to subsection (4B), a person who is guilty of an offence under subsection (2) shall be liable on conviction to a fine not exceeding $10,000 or to imprisonment for a term not exceeding 5 years or to both.(4B) If a person —

(a)

has a previous conviction under subsection (2) or section 11P(2); and

(b)

is convicted of an offence under subsection (2),that person shall on conviction be punished with imprisonment for a term of not less than one year and not more than 5 years.”.
