Amendment of section 40
In the principal Act, in section 40 —
(a)
renumber the section as subsection (1) of that section; and
(b)
after subsection (1), insert —“(2) A District Court has jurisdiction to hear and determine any action for a civil penalty to be imposed in respect of a contravention of a provision under Part 3, 3A, 3B, 3C or 3D regardless of the monetary amount of the civil penalty.”.
