Amendment of section 31

In the MACMA, in section 31 —

(a)

in subsection (1), replace paragraph (a) with —“(a)any order made or judgment given by a court or other competent authority of a prescribed foreign country —

(i)

purporting to bear the seal of that court or competent authority; or

(ii)

purporting to be signed by —

(A)

a person in his or her capacity as a judge, magistrate or officer of the court; or

(B)

an officer of the competent authority,is deemed without further proof to have been duly sealed, or signed by that person, as the case may be; and”;

(b)

in subsection (1)(b), after “court”, insert “or other competent authority”; and

(c)

replace subsection (2) with —“(2) A document is duly authenticated for the purposes of subsection (1)(b) if it purports to be certified —

(a)

by a person in his or her capacity as a judge, magistrate or officer of the court of that country;

(b)

by an officer of the competent authority of that country; or

(c)

by or on behalf of the appropriate authority of that country.”.
