Directions
(1)
In lieu of or in addition to issuing an employer a contravention notice under section 31, an authorised officer may —
issue any directions to the employer that the authorised officer thinks appropriate to bring the civil contravention to an end; and
if necessary, require the employer to take any action that is specified in the direction to remedy, mitigate or eliminate any effects of the civil contravention and to prevent the recurrence of the civil contravention.
(2)
An employer who, without reasonable excuse, fails to comply with a direction given to the employer under subsection (1) shall be guilty of an offence and shall be liable on conviction —
if the employer is a body corporate, partnership or unincorporated association — to a fine not exceeding $5,000; or
if the employer is an individual — to a fine not exceeding $2,500 or to imprisonment for a term not exceeding 6 months or to both.
