Amendment of section 377C
In the Penal Code 1871, in section 377C(1) —
(a)
in the definition of “child abuse material”, after “following”, insert “(whether or not any child was involved in the production of the material)”; and
(b)
replace the second definition of “image” with —“ “image”, in relation to a person, means —
(a)
an image of a human being who is not fictional or imaginary (whether identifiable or not); or
(b)
an image of a fictional or imaginary human being that so closely resembles an image of a human being who is not fictional or imaginary (whether identifiable or not) as to make it difficult for an ordinary person to distinguish the firstmentioned image from an image of a human being who is not fictional or imaginary;”.
