Clause 8

Transitional provision for section 2(2)(b) of Children and Young Persons (Amendment) Act 2019

(1)

A District Court or Magistrate’s Court before which a person is charged with an offence (other than an offence specified in the Second Schedule to the Children and Young Persons Act 1993) may remit the case to the Youth Court if —

(a)

the person is 16 years of age or older but below 18 years of age;

(b)

the person was charged with the offence before the date of commencement of section 2(2)(b) of the Children and Young Persons (Amendment) Act 2019;

(c)

the person has not pleaded guilty to the offence; and

(d)

the trial against the person for the offence has not commenced.

(2)

To avoid doubt, subsection (1) does not affect the powers of the District Court or Magistrate’s Court under section 39(4) of the Children and Young Persons Act 1993.
