Amendment of section 37R
In the ITA, in section 37R, after subsection (31), insert —“(31A) Where an amount of cash payout is to be made by the Comptroller to an eligible person under this section, and an amount is recoverable by the Comptroller from the eligible person as a debt due to the Government under subsection (20), (21), (22) or (30) —
the amount of cash payout to be made by the Comptroller to the eligible person is reduced by the amount so due under that subsection; and
the amount of the reduction is treated as a repayment of the debt by the eligible person.(31B) Where the amount of cash payout to be made to an eligible person under this section is less than the sum of the amount of tax, duty, interest or penalty due from the eligible person under subsection (28) and the amount recoverable as a debt due to the Government under subsection (20), (21), (22) or (30), the Comptroller may determine the amount of reduction to be made under subsection (28)(a) or (31A)(a), or both, in a manner that he or she considers reasonable.”.
