Amendment of section 35
In the Industrial Relations Act 1960, in section 35 —
(a)
replace subsection (9) with —“(9) Any direction of the Minister under subsection (6) operates as a bar to the following actions by the employee in any court in respect of the wrongful dismissal:
(a)
any action for damages;
(b)
any action for discrimination.”; and
(b)
after subsection (11), insert —“(12) In this section, “action for discrimination” has the meaning given by section 2 of the Workplace Fairness Act 2025.”.
