Clause 70

Publicity regarding non‑compliance with directions, etc.

(1)

If the Commissioner is satisfied that the recipient of a Part 5 direction or an order following non‑compliance (called in this section the relevant recipient) fails to comply with the direction or order, the Commissioner may publish a statement to that effect on the official website of the Commissioner.

(2)

If the statement mentioned in subsection (1) has been published on the official website and the Commissioner is satisfied that the relevant recipient has complied with the Part 5 direction or order following non‑compliance for which the statement was published, the Commissioner may remove the statement from the official website.

(3)

Statements published under this section are protected by absolute privilege.
