Tort of incitement of violence
(1)
A person (X) must not make any communication that constitutes incitement of violence.
(2)
If X contravenes subsection (1), a victim of incitement of violence may bring civil proceedings in a court against X.
(3)
In any proceedings mentioned in subsection (2), it is a defence for X to prove that X’s conduct was reasonable.
(4)
In this section, each member of the group against which the unlawful force or unlawful violence is incited or likely to be incited is a victim.
