Clause 97

Damages for incitement of violence

(1)

Subject to subsections (2), (3) and (4), in any civil proceedings brought under Part 10, 11 or 12 in relation to the online harmful activity of incitement of violence, the court may award damages to the members of the group that is the subject of those proceedings.

(2)

The court may determine the amount of the damages mentioned in subsection (1), as the court thinks just and equitable, having regard to all the circumstances, including the loss or harm suffered by members of the group or suffered by the group as a whole.

(3)

The damages mentioned in subsection (1) are to be allocated and distributed in accordance with the procedures that may be prescribed in Rules of Court made under section 104.

(4)

Where it is not possible or practicable to allocate or distribute all or any part of the damages awarded under this section, the court may order that those damages be applied to purposes and activities that will fulfil the objectives of the group or otherwise for its benefit.
