Procedure for designation
(1)
If the competent authority intends to designate an entity, the competent authority must give notice of the intention to the entity.
(2)
The entity may submit representations to the competent authority in the prescribed form and manner within —
14 days after notice is given under subsection (1); or
any longer period specified by the competent authority.
(3)
The competent authority may designate the entity —
after the expiry of the period for making representations under subsection (2); or
after considering any representations made by the entity in accordance with subsection (2).
(4)
If the competent authority decides to designate the entity, the competent authority must give notice of the decision to the entity.
(5)
The designation takes effect from —
the date on which notice is given under subsection (4); or
any later date specified by the competent authority.
