Clause 21
Grant of approval
(1)
After considering an application for approval under section 20 for a licensee to —
appoint an individual as a key appointment holder of the licensee;
appoint an individual as the person‑in‑charge of the licensable SRH to which the licensee’s licence relates; or
deploy an individual to carry out a prescribed duty or a duty belonging to a prescribed class of duties in relation to —
the operation of the licensable SRH to which the licensee’s licence relates; or
the management of the residents of that licensable SRH,the Director‑General may —
on payment of a fee (if prescribed), grant the approval; or
refuse to grant the approval.

The Director‑General must not grant approval for a licensee to —
appoint an individual as a key appointment holder of the licensee;
appoint an individual as the person‑in‑charge of the licensable SRH to which the licensee’s licence relates; or
deploy an individual to carry out a prescribed duty or a duty belonging to a prescribed class of duties in relation to —
the operation of the licensable SRH to which the licensee’s licence relates; or
the management of the residents of that licensable SRH,if the Director‑General is satisfied that the individual is not a suitable person to be so appointed or so deployed.
