Amendment of section 53
In the Active Mobility Act, in section 53 —
(a)
in subsections (1) and (5), replace “one month’s notice in the Gazette” with “notice in accordance with subsection (5A)”; and
(b)
after subsection (5), insert —“(5A) The notice required by subsection (1) or (5) is given by publishing a notice of the intended sale, destruction or disposal in the Gazette —
(a)
in the case of a vehicle mentioned in section 51(3) — at least 7 days before taking any action under subsection (1);
(b)
in the case of a vehicle mentioned in subsection (5)(a) — at least 7 days before taking any action under subsection (5); and
(c)
in any other case — at least one month before taking any action under subsection (1) or (5), as the case may be.”.
