Clause 52

Amendment of section 5

In the Road Traffic Act, in section 5 —

(a)

in subsection (5B), replace “or authorising” with “, authorising or permitting”;

(b)

replace subsections (7) and (7AA) with —“(7) Any person who is guilty of an offence under subsection (5) or (6) shall be liable on conviction —

(a)

where the person is an individual —

(i)

to a fine not exceeding $20,000 or to imprisonment for a term not exceeding 2 years or to both; but(ii)where the individual is a repeat offender, to a fine not exceeding $40,000 or to imprisonment for a term not exceeding 4 years or to both; or

(b)

in any other case —

(i)

to a fine not exceeding $40,000; but(ii)where the person is a repeat offender, to a fine not exceeding $80,000.”; and

(c)

in subsection (10), in the definition of “repeat offender”, replace “subsection (7AA)” with “subsection (7)”.
