Clause 67

No proceedings may be brought by a person making a claim for money overpaid or erroneously paid in respect of any collection or payment of any road‑use charge or any other prescribed charge, cost or fee under this Act or any other written law, that is collected or paid through a device or appurtenance installed in or on the vehicle under rules made under section 34D(1), unless the claim is made before the end of 3 months (or such longer period as may be prescribed in substitution) after the overpayment or erroneous payment of the road‑use charge or the other charge, cost or fee, as the case may be.(2) However, nothing in subsection (1) applies in relation to, or may be construed to affect, any road‑user charge as defined in section 34A as in force before the date of commencement of section 62 of the Land Transport and Related Matters Act 2026 or charge, cost or fee, that is collected or paid before that date.”.
