Amendment of section 4
In the Road Vehicles (Special Powers) Act 1960, in section 4, after subsection (7), insert —“(8) Despite subsections (1) and (6), a court need not make an order for the forfeiture of a road vehicle that has been seized by the police if it is proved to the satisfaction of the court that the person who committed the scheduled offence involving the road vehicle —
(a)
is not the owner of the road vehicle; and
(b)
had used the road vehicle without the consent of the owner.”.
