Clause 42

Malaysian officers deemed to be public servants, etc.

(1)

Every —

(a)

Malaysian preclearance officer while on duty or carrying out work, in that capacity, conducting border clearance or railway security checks, or performing any preparatory work, within a Malaysia designated area in Singapore; or

(b)

Malaysian incident management officer while on duty or carrying out work, in that capacity, conducting incident management operations in Singapore in relation to a cross‑border incident,is deemed to be a public servant for the purposes of the provisions in subsection (2).

(2)

The provisions for the purposes of subsection (1) are any of the following:

(a)

section 6 of the Protection from Harassment Act 2014;

(b)

sections 152, 189, 332, 333 and 353 of the Penal Code 1871.
