New section 28A
In the TCASA, after section 28, insert —“Certificate relating to product or substance28A. A certificate purporting —
(a)
to be signed by —
(i)
an analyst employed by the Authority; or
(ii)
a person appointed by the Minister, including a person appointed under section 19J(10) or 19K(8); and
(b)
to relate to a product or substance that is the subject of an offence under this Act,is to be admitted in evidence, in any proceedings for an offence under this Act, on its production by the prosecution without proof of signature and, until the contrary is proved, is proof of all matters contained in the certificate.”.
