Application to General Division of High Court
(1)
The Council may apply to the General Division of the High Court for an extension of the period for which an interim order made under section 66(2) or 68(3)(c) or (d) has effect, and may apply again for one or more further extensions.
(2)
On an application under subsection (1), the General Division of the High Court may grant an extension (or a further extension) for a period not exceeding 12 months.
(3)
The General Division of the High Court may, on an application by the registered veterinarian concerned —
in the case of an interim suspension order — revoke the order;
in the case of an interim restriction order — revoke the order or amend, vary or revoke any condition or restriction imposed by the order; or
in either case — substitute for the period specified in the order (or in the order extending it) some other period which could have been specified in the order when it was made, or in the order extending it.
(4)
An application under subsection (3) must be made within 14 days after service of the notice on the registered veterinarian concerned of the interim order under section 66(3) or 68(4), as the case may be.
(5)
An application under subsection (3) must be heard otherwise than in open court.
(6)
The General Division of the High Court may, on an application by the registered veterinarian, order that any information contained in any document relating to an application under subsection (3) must not be published or disclosed, unless —
the registered veterinarian consents to the publication or disclosure; or
the General Division of the High Court is satisfied that the information if published or disclosed does not disclose any confidential information.
