This Order may be cited as the Building Control (Exemption from Accredited Checking Organisation Requirements) Order.

Regulation 2

Subject to paragraph 3, any building works in respect of which —

(a)

an accredited checker had been appointed under section 17(1) of the Act; and

(b)

an application for approval of any detailed structural plans and calculations had been submitted to the Commissioner of Building Control under section 6(1) of the Act,before 1st September 2001 shall be exempt from sections 16(5B) and 17(2) of the Act.

Cessation of exemption

The building works referred to in paragraph 2 shall cease to be exempt from sections 16(5B) and 17(2) of the Act if, on or after 1st September 2001, the accredited checker appointed in respect of the building works —

(a)

ceases to be registered as an accredited checker under section 16 of the Act or has his registration as an accredited checker suspended or cancelled; or

(b)

ceases to be the accredited checker appointed in respect of those building works.
