Citation and commencement
This Order may be cited as the Building Control (Retrofitting of Casement Windows) Order 2004 and shall come into operation on 1st October 2004.

Regulation 2
Definitions
In this Order —“approved window contractor” has the same meaning as in the Building Control Regulations 2003 (G.N. No. S 666/2003);“Authority” means the Building and Construction Authority;“casement window” means a window, or part thereof, which opens on hinges, pivots or variable geometry stays;“trained window installer” has the same meaning as in the Building Control Regulations 2003 (G.N. No. S 666/2003).

Regulation 3
Application
This Order shall apply to casement windows which —
(a)
are installed on or form part of the exterior of any residential building;
(b)
open outwards; and
(c)
are fitted with aluminium rivets at the variable geometry stays.
Regulation 4
Applicable date, grace period and prescribed age
Subregulation 1
The applicable date in relation to any casement window to which this Order applies shall be 1st October 2004.
Subregulation 2
The grace period in relation to any casement window to which this Order applies shall be a period of 12 months.
Subregulation 3
The prescribed age in relation to any casement window to which this Order applies shall be 5 years reckoned from —
(a)
the date the first temporary occupation permit (or its equivalent) or the first certificate of statutory completion is issued in respect of the building on which the casement window is installed, whichever is earlier; or
(b)
in any case where the casement window was installed or replaced after the date referred to in paragraph (a), the date on which the last installation or replacement of that window was completed.
Regulation 5
Duty to retrofit
For the purposes of section 22B(1) of the Act, where any casement window to which this Order applies has been installed on or forms part of a building before 1st October 2004, the person responsible for that casement window shall engage an approved window contractor to carry out retrofitting of that casement window —
(a)
where the casement window is 5 years old or older on 1st October 2004, within the grace period of 12 months starting from 1st October 2004; or
(b)
where the casement window is less than 5 years old on 1st October 2004 —
(i)
within the grace period of 12 months starting from 1st October 2004; or
(ii)
within the period before the casement window attains the prescribed age of 5 years,whichever period is longer.

Retrofitting by trained window installer

Subject to paragraph (1A), no person shall retrofit any casement window unless —
(a)
he is a trained window installer; or
(b)
he is doing so under the supervision and guidance of a trained window installer.

No trained window installer shall retrofit, or supervise and guide the retrofitting of, any casement window unless he is —
(a)
a director;
(b)
a partner;
(c)
the sole proprietor; or
(d)
an employee,of an approved window contractor engaged under paragraph 5.

Any person who contravenes sub-paragraph (1) or (1A) shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $5,000 or to imprisonment for a term not exceeding 6 months or to both.

Every approved window contractor and every trained window installer engaged to carry out retrofitting of any casement window shall —
(a)
retrofit the casement window by replacing all its aluminium rivets at the variable geometry stays with stainless steel rivets of type 304 complying with BS EN 10088 or its equivalent; and
(b)
immediately after retrofitting the window but before leaving the site of the retrofitting, take all necessary steps to ensure that the casement window had been properly and securely retrofitted.
Subregulation 2
Any approved window contractor or trained window installer who fails to comply with sub-paragraph (1) shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $5,000 or to imprisonment for a term not exceeding 6 months or to both.
Regulation 8
Retrofitting report
The person responsible shall, as soon as is reasonably practicable after the retrofitting works under paragraph 5 have been completed, submit a report of the completed retrofitting works to the Commissioner of Building Control, in such form as the Commissioner of Building Control shall determine.
