Amendment of Article 5 of the Constitution of Malaysia

Article 5 of the Constitution of Malaysia is hereby amended by inserting immediately after clause (5) thereof the following clause: —“(6) Nothing in this Article shall invalidate any law —

(a)

in force before the 16th day of September 1963, which authorises the arrest and detention of any person in the interests of public safety, peace and good order; or

(b)

relating to the misuse of drugs which authorises the arrest and detention of any person for the purpose of treatment and rehabilitation,by reason of such law being inconsistent with the provisions of clauses (3) and (4) of this Article, and, in particular, nothing in this Article shall affect the validity or operation of any such law before the commencement of the Constitution (Amendment) Act, 1977.”.
