This Act may be cited as the Constitution of the Republic of Singapore (Amendment) Act 1994 and shall come into operation on such date as the President may, by notification in the Gazette, appoint.(2) The President may appoint different dates for the coming into operation of the different provisions of this Act.

Clause 2

Amendment of Article 34

Article 34(2)(a) of the Constitution of the Republic of Singapore (referred to in this Act as the Constitution) is amended by deleting the word “grade” and substituting the word “office”.

New Article 111A

The Constitution is amended by inserting, immediately after Article 111, the following Article:“Promotion to significant grade111A.—

(1)

The President may, by notification in the Gazette, designate as significant a grade each in the Administrative Service Scheme of Service and the Administrative (Foreign Service) Scheme of Service (referred to in this Article as the significant grade), and such notification may be subsequently amended to designate as significant any other grade in those Schemes of Service not lower than the grade first so designated.(2) Notwithstanding any other provision in the Constitution, any appointment or promotion of a public officer to the significant grade shall be made by the President, acting in accordance with the advice of the Prime Minister, from public officers nominated by the Public Service Commission.”.

Nothing in sections 2 and 4 of this Act shall affect the appointment or promotion of any person made before the commencement of those sections.

Nothing in section 3 of this Act shall apply to any appeal, application for leave or application for special leave to appeal made under any written law or enactments in force before the commencement of section 3; and such written law or enactments shall continue to apply to such appeal, application for leave or application for special leave as if section 3 had not been enacted.
