Export of Plants (Control) Act

Any person who contravenes the provisions of this Act or who fails to comply with or breaks any condition imposed thereunder shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $2,000.

A Magistrate’s Court shall have jurisdiction to hear and determine all prosecutions under this Act and, notwithstanding anything to the contrary in the Criminal Procedure Code [Cap. 68], may impose the full penalty or punishment provided by this Act.

Any person generally or specially authorised in writing in that behalf by the agricultural officer may seize any plant together with any package, vessel or vehicle which may reasonably be believed to be the subject matter of an offence under this Act or to be or about to be used in the commission of an offence.

When any person is convicted of an offence under the provisions of this Act any plant with respect to which the offence was committed may be forfeited by order of the court.

Any order of forfeiture of any plant under this section may include any package, vessel or vehicle in which the plant is found.

The Minister may order any vessel or vehicle seized under this section whether forfeited or not to be delivered to the proprietor thereof upon such terms and conditions as he may consider fit.
