Land Acquisition (Amendment) Bill

by deleting paragraph (a) of subsection (1) and substituting the following paragraph:“(a)the market value —

as at 30th November 1973 in respect of land acquired before 30th November 1987, and as at 1st January 1986 in respect of land acquired on or after that date;

as at the date of the publication of the notification under section 3(1) if the notification is, within 6 months from the date of its publication, followed by a declaration under section 5 in respect of the same land or part thereof; or

as at the date of the publication of the declaration made under section 5,whichever is the lowest;”;

by deleting paragraph (b) of subsection (3) and substituting the following paragraph:“(b)the market value of the land as at 30th November 1973 in respect of land acquired before 30th November 1987, and the market value of the land as at 1st January 1986 in respect of land acquired on or after that date,”; and

by inserting, immediately after subsection (5), the following subsection:“(6) For the purposes of this section, the date of acquisition of any land shall be the date of the publication of the notification under section 5(1) declaring that that land is needed for the purpose specified in the declaration.”.
