Clause 1

Short title and commencement

This Act may be cited as the Prohibition on Smoking in Certain Places (Amendment) Act, 1973 and shall come into operation on such date as the Minister may, by notification in the Gazette, appoint.

Clause 2

Amendment of Section 2

Section 2 of the Prohibition on Smoking in Certain Places Act (hereinafter in this Act referred to as “the principal Act”) is hereby amended —

(a)

by inserting immediately after the definition of “manager” appearing therein the following new definition: —“ “omnibus” means a public service vehicle which is used for the conveyance of passengers for hire or reward on a scheduled service in which passengers are charged separate and distinct fares;”; and

(b)

by inserting immediately after the definition of “public health auxiliary” appearing therein the following new definition: —“ “public service vehicle” has the same meaning as in the Road Traffic Act (Cap. 92),”.

Clause 3

Amendment of section 4

Subsection (1) of section 4 of the principal Act is hereby amended —

(a)

by deleting the comma appearing at the end of paragraph (b) thereof and substituting therefor the expression “; or”;

(b)

by inserting immediately after paragraph (b) thereof the following new paragraph: —“(c)in any omnibus while it is carrying fare-paying passengers on a scheduled or regular route,”; and

(c)

by deleting the words “and specified buildings” appearing in the marginal note thereto and substituting therefor the expression “, specified buildings and in omnibuses”.

Amendment of section 5

Section 5 of the principal Act is hereby amended —

(a)

by inserting immediately after the word “building” appearing in the second line of subsection (1) thereof the words “and the owner of every omnibus”;

(b)

by inserting immediately after the word “manager” appearing in the first line of subsection (2) thereof the words “or owner”;

(c)

by inserting immediately after the word “spectators” appearing in the fourth line of subsection (2) thereof the expression “, passengers”; and

(d)

by inserting immediately after the word “building” appearing in the second line of subsection (4) thereof the words “and the owner of any omnibus”.

Clause 5

Amendment of section 6

Section 6 of the principal Act is hereby amended —

(a)

by deleting the comma appearing at the end of paragraph (b) of subsection (1) thereof and substituting therefor the expression “; or”;

(b)

by inserting immediately after paragraph (b) of subsection (1) thereof the following new paragraph: —“(c)the conductor or ticket inspector of any omnibus,”;

(c)

by deleting the words “or specified building” appearing in the eighth and ninth lines of subsection (1) thereof and substituting therefor the expression “, specified building or omnibus”;

(d)

by deleting the words “or specified building” appearing in the last line of subsection (1) thereof and substituting therefor the expression “, specified building or omnibus”;

(e)

by deleting the words “or specified building” appearing in the second line of subsection (2) thereof and substituting therefor the expression “, specified building or omnibus”;

(f)

by inserting immediately after the expression “(b)” appearing in the third line of subsection (2) thereof the expression “or (c)”;

(g)

by inserting immediately after the expression “(b)” appearing in the third line of subsection (3) thereof the expression “or (c)”; and

(h)

by inserting immediately after the word “building” appearing in the second line of subsection (4) thereof the words “or an omnibus”.
