This Order may be cited as the Road Traffic (TUM CREATE Three‑Wheeled Electric Motor Cycle Trial) (Exemption) Order 2015.(2) Subject to sub‑paragraph (3), the period for which this Order is in force starts on 30 November 2015 and ends on 29 November 2017.(3) This Order lapses immediately if any prototype vehicle is used on any road outside the specified area at any time.

In this Order —“prototype vehicle” means an electric three‑wheeled motor cycle, adapted for the carriage of goods, that is developed by TUM CREATE;“qualified person” means an individual —

(a)

who holds a valid Class 2A driving licence issued under the Road Traffic (Motor Vehicles, Driving Licences) Rules (R 27);

(b)

who has undergone training by TUM CREATE on how to operate a prototype vehicle; and

(c)

who is registered with, and authorised by, TUM CREATE to operate a prototype vehicle;“specified area” means the areas delineated in Parts 1 and 2 of the First Schedule;“specified rules” means the rules specified in the Second Schedule;“TUM CREATE” means the company incorporated under the Companies Act (Cap. 50) as TUM CREATE Limited (Registration No. 201013955Z).

Subject to sub‑paragraph (3), Part I and sections 90 and 91 of the Act, and the specified rules, do not apply to or in relation to a prototype vehicle which is used by any qualified person on any road within the specified area, where the vehicle is used for or in connection with —

(a)

any assessment of the functionality and reliability of the vehicle; or

(b)

the conduct of research on the range performance or electric drivetrain optimisation of the vehicle.

Subject to sub‑paragraph (3), Part I of the Act, and the specified rules, do not apply to or in relation to a prototype vehicle that is kept within the specified area.

Suggest a correction

The exemptions in sub‑paragraphs (1) and (2) are subject to the following conditions:

(a)

the prototype vehicle is the only prototype vehicle in use on any road within the specified area at any one time;

(b)

there is in force, at any time a prototype vehicle is used or kept on any road within the specified area, a policy of insurance in relation to the use of the vehicle by any person, insuring against any liability in respect of the death of, bodily injury sustained by, or property damage suffered by any person caused by or arising out of the use of the vehicle;

(c)

the risk under the policy of insurance referred to in sub‑paragraph (b) is assumed by an insurer who, at the time of issuance of the policy, is lawfully carrying on an insurance business in Singapore.
