Clause 1

Short title and commencement

This Act may be cited as the Singapore Telephone Board (Amendment) Act, 1965, and shall be deemed to have come into operation on the 9th day of August, 1965.

Clause 2

Amendment of section 2

Section 2 of the Singapore Telephone Board Ordinance (hereinafter in this Act referred to as “the Ordinance”) is hereby amended —

(a)

by deleting the words “of the State” appearing at the end of the definition of “public officer” therein; and

(b)

by inserting immediately after the word “Government” appearing in the penultimate line of the definition of “public safety” therein the words “or the Government of Malaysia”.

Amendment of section 5

Subsection (1) of section 5 of the Ordinance is hereby amended by deleting the word “three” appearing in paragraph (c) thereof and substituting therefor the word “five”.

Subsection (1) of section 15 of the Ordinance is hereby amended by deleting the words “of the Federation” appearing immediately after the word “Government” in paragraph (f) thereof.

Subsection (1) of section 17 of the Ordinance is hereby amended by deleting the words “Federal Minister for Finance” appearing in the second line thereof and substituting therefor the words “Minister for Finance”.

Amendment of section 22

Subsection (2) of section 22 of the Ordinance is hereby amended by deleting paragraph (b) thereof and substituting therefor the following: —“(b)to the payment of such interest on shares and stock issued by the Board as the state of the undertakings and the financial position of the Board appear, in the opinion of the Board, to warrant.”.

Amendment of section 24

Subsection (4) of section 24 of the Ordinance is hereby amended by deleting the words “laid before the House of Representatives” appearing at the end thereof and substituting therefor the words “presented to Parliament”.

Subsection (2) of section 26 of the Ordinance is hereby amended by deleting the words “laid before the House of Representatives” appearing at the end thereof and substituting therefor the words “presented to Parliament”.

Clause 9

New section 34

The Ordinance is hereby amended by inserting at the beginning of Part V thereof and immediately before section 35 therein the following new section: —“General power to acquire land34.—

(1)

Where any immovable property, not being State land, is needed for the purposes of the Board and cannot be acquired by agreement, the President may, if he thinks fit, direct the acquisition of such property, and in such case, such property may be acquired in accordance with the provisions of any written law relating to the acquisition of land for a public purpose and any declaration required under any such written law that such land is so needed may be made notwithstanding that compensation is to be paid out of the funds of the Board, and such declaration shall have effect as if it were a declaration that such land is needed for a public purpose made in accordance with such written law.(2) The expenses and compensation in respect of any immovable property acquired under this section shall be paid by the Board.(3) Where any immovable property has been acquired under this section, the Board shall take out the necessary documents of title in respect of such property and shall pay the rent to which such property is subject.(4) Nothing in this section shall apply to the acquisition of any property in respect of which special provision in that behalf is contained in this Ordinance.”.

Amendment of section 39

Amendment of Schedule

The Schedule to the Ordinance is hereby amended by deleting the expression “COLONY OF SINGAPORE” appearing therein.

Miscellaneous amendments

(1)

The following sections of the Ordinance are hereby amended by deleting the words “Federal Minister” wherever they appear therein and substituting therefor in each case the word “Minister”: —Sections 5(1), 5(3), 5(4), 5(5), 5(6), 5(7), 6(1), 8, 21(1), 24(3), 24(4), 26(1), 26(2), 41(2) and 49(1).
