Citation and commencement
This Order is the Small Motorised Vehicles (Safety) (Keeping Unsafe Device — Exemption) Order 2026 and comes into operation on 1 June 2026.
Exemption for person granted import approval
Section 8A(1) of the Act does not apply to a person who keeps an unsafe device at any place if —
the person is granted an import approval authorising the person to import that unsafe device as a non‑compliant small motorised vehicle under regulation 8 of the Small Motorised Vehicles (Safety) Regulations 2021; and
the import approval is in force.
