These Regulations are the Social Residential Homes (Board of Visitors) Regulations 2026 and come into operation on 1 July 2026.

In these Regulations —“Board” means a Board of Visitors appointed under section 36(1) of the Act;“Minister” includes any Permanent Secretary to the Ministry of Social and Family Development.

Regulation 3

Chairperson

The Chairperson of a Board must be appointed by the Minister from among the members of the Board.

Meetings of Board

Subregulation 1

The quorum for a meeting of a Board is 3 members.

Subregulation 2

No business may be transacted at a meeting of a Board if a quorum is not present.

A member of a Board may participate in a meeting of the Board through any means of communication (such as over the telephone or through a live audio, live video or live television link) as the Board may determine.

Subregulation 4

A member of a Board who participates in a meeting of the Board in accordance with paragraph (3) is taken to be present at the meeting.

Resignation of Board member

Any member of a Board may resign by giving written notice to the Minister.

Visits by Board

A Board appointed in relation to a licensable SRH must, through any of its members, visit the licensable SRH at least once every 3 months.

Subregulation 1

After each visit by a Board to a licensable SRH, the Board must submit to the Director‑General a report containing the following:

(a)

any observation arising from the visit relating to the living conditions of the licensable SRH, or standard of care, biopsychosocial intervention or support to carry out daily activities provided at the licensable SRH;

(b)

any recommendation to improve the living conditions, or standard of care, biopsychosocial intervention or support to carry out daily activities provided to the residents of the licensable SRH, that the Board considers necessary.

After receiving a recommendation mentioned in paragraph (1)(b), the Director‑General may take any action that the Director‑General considers appropriate.

Subregulation 3

Where a Board knows or has reason to believe that there is an irregularity in the management or treatment of any resident of the licensable SRH, the Board must, as soon as is practicable, inform the person‑in‑charge of a licensable SRH and the Director‑General of the irregularity.

Regulation 8

Additional function of Board

In addition to the functions mentioned in section 36(4) of the Act, it is also a function of a Board to receive and hear any report or complaint made by any resident of a licensable SRH.
