This Order may be cited as the International Organisations (Immunities and Privileges) (APEC Secretariat) Order.
The APEC Secretariat is an organisation of the nature indicated in section 2(1) of the International Organisations (Immunities and Privileges) Act.
The APEC Secretariat shall have the legal capacities of a body corporate.
The APEC Secretariat shall have the like inviolability of official archives and premises occupied as offices as is accorded in respect of official archives and premises of an envoy of a foreign sovereign Power accredited to the Republic of Singapore:Provided that the Secretariat shall not permit its premises to be used as a refuge for avoiding arrest under the laws of Singapore or in any other manner incompatible with the purposes of the Secretariat.
The APEC Secretariat shall have the like exemption or relief from taxes and rates, other than taxes on the importation of goods, as is accorded to a foreign sovereign Power:Provided that the Secretariat shall not claim exemption from taxes which are charges for public services.
The APEC Secretariat shall have exemption from taxes on the importation of goods directly imported by the Secretariat for its official use in the Republic of Singapore or for exportation, or on the importation of any of the publications of the Secretariat directly imported by it, such exemption to be subject to compliance with such conditions as the Director-General of Customs and Excise may prescribe for the protection of the revenue.
The APEC Secretariat shall have exemption from prohibitions and restrictions on importation or exportation in the case of goods directly imported or exported by the Secretariat for its official use and in the case of any publications of the Secretariat directly imported or exported by it.
Except in so far as in any particular case any privileges or immunity is waived, the Executive Director and the staff of the Secretariat shall enjoy within and with respect to the territory of Singapore —
while exercising their functions as such, immunity from personal arrest or detention and from seizure of their personal baggage and inviolability of their residence and of all papers and documents relating to the work of the Secretariat;
immunity from legal process in respect of acts, including words spoken or written, done by them in their official capacity and in the discharge of their duties; and
while exercising their functions, the like exemption or relief from taxes as is accorded to an envoy of a foreign sovereign Power accredited to the Republic of Singapore.
For the purposes of the application of this Order —
“Executive Director” means the Executive Director of the APEC Secretariat or his authorised representative;
“staff of the Secretariat” means all the professional staff members of the Secretariat.
The provisions of paragraphs (1) and (2) shall not confer any immunity or privilege upon any person who is a citizen or permanent resident of Singapore.
The names of the persons to whom the provisions of Article 8 apply shall be set forth in a list compiled and published from time to time by the President under section 2(3) of the Act, and such list shall show in regard to each person the date as from which, for the purposes of this Order, he first held the office or employment in question, and the date when he ceased to hold that office or employment.
