These Rules may be cited as the Public Entertainments Rules.

In these Rules, unless the context otherwise requires —“licence” means a licence issued or renewed, or to be issued or renewed, under the Act by the Public Entertainment Licensing Officer;“Licensing Officer” means the Public Entertainment Licensing Officer.

The website https://www.police.gov.sg/Business-E-Services/Apply-for-Public-Entertainment-Licence is prescribed for the purpose of section 5(3) of the Act (relating to criteria and requirements to be satisfied by an applicant for a licence).

A licensee may, at any time, apply to the Licensing Officer to amend the name or address of the specified establishment stated in the licence.

Transfer of licence

A licensee shall not permit his licence to be used by any other person.

A licensee shall not transfer his licence to any other person without the approval of the Licensing Officer.

An application for the transfer of a licence shall be made in such form as the Licensing Officer may determine.

Extension of hours of operation and upgrading of licence

A licensee may not extend the hours of operation of a specified establishment beyond the hours provided for in the licence unless he has —

(a)

obtained the approval of the Licensing Officer; and

(b)

paid the appropriate fee as determined in accordance with the formula in rule 6(2).

A licensee may upgrade a licence from category 2 to category 1 provided that he has —

(a)

obtained the approval of the Licensing Officer; and

(b)

paid the appropriate fee as determined in accordance with the formula in rule 6(2).

Any approval granted to a licensee by the Licensing Officer under paragraph (1) or (2) shall take effect from such date as may be specified by the Licensing Officer and be valid for the remaining period of the licence being held by the licensee.

Subject to paragraph (2), the fees payable for the purposes of these Rules shall be as specified in the Second Schedule.

Where a licensee applies to the Licensing Officer —

(a)

under rule 5(1)(a) for an approval for the extension of the hours of operation of a specified establishment; or

(b)

under rule 5(2)(a) for an approval for the upgrading of his licence,the fee payable by him for such extension or upgrading shall be determined in accordance with the formulawhere Xis the fee as specified in the Second Schedule, for —

(a)

the type of licence that allows for the hours of operation desired by the licensee; or

(b)

a category 1 licence;Yis the fee that has already been paid for the licence currently being held by the licensee; andZis the remaining validity period (rounded to the nearest month) that the licence currently being held by the licensee bears to the total validity period of that licence.

The fee payable under paragraph (2) shall be rounded off to the nearest dollar, except that where the fraction of a dollar is 50 cents, it shall be regarded as a dollar.

Where applicable, the fee payable for a category 4 licence shall be pro-rated according to the proportion which the remaining validity period (rounded to the nearest month) that the licence currently being held by the licensee bears to the total validity period of that licence.

Except where the Licensing Officer considers appropriate, no refund shall be made in respect of any fee paid under these Rules.

Regulation 7

Savings

Any licence, application or other document issued, made or given under the revoked Public Entertainments Rules (R 1, 1990 Ed.) shall have the same force and effect as if it had been issued, made or given under these Rules.
