In this Order —“certificate of insurance” means —

(a)

for the purposes of paragraphs 3 and 4, a certificate of insurance, certificate of security or certificate of foreign insurance; or

(b)

for the purposes of paragraph 5, a certificate of insurance or certificate of security,which complies with the Motor Vehicles (Third-Party Risks and Compensation) Act (Cap. 189);“foreign vehicle” means any motor vehicle which is not registered under the Act, but which is registered under the provisions of any law of any country (being a country other than Singapore) relating to motor vehicles;“general licence” means a general licence issued under section 28 of the Act in respect of vehicles which include one or more foreign vehicles;“vehicle entry permit” means a vehicle entry permit granted under the Road Traffic (International Circulation) Rules (R 7).

Definition

“certificate of insurance” means —

(a)

for the purposes of paragraphs 3 and 4, a certificate of insurance, certificate of security or certificate of foreign insurance; or

(b)

for the purposes of paragraph 5, a certificate of insurance or certificate of security,which complies with the Motor Vehicles (Third-Party Risks and Compensation) Act (Cap. 189);

Regulation 3

Exemption for citizen or permanent resident of Singapore

Subregulation 1

Suggest a correction

Any person who is a citizen or permanent resident of Singapore shall be exempted from section 12 of the Act in respect of any vehicle not registered under the Act, if the following conditions are satisfied:

(a)

he resides outside Singapore;

(b)

he works and resides in Malaysia;

(c)

he or his spouse is the registered owner of the vehicle, or his employer is the registered owner of the vehicle and has provided him with the vehicle, or his employer has hired the vehicle for use by him alone;

(d)

there is in force in respect of the vehicle —

(i)

a valid approval under rule 3 of the Road Traffic (Exemption from Section 12 — Approval) Rules (R 45) in relation to the use of the vehicle by him;

(ii)

a certificate of insurance which is valid for the period of validity of that approval; and

(iii)

a vehicle entry permit;

(e)

he keeps or uses the vehicle in Singapore only —

(i)

on Saturdays, Sundays and public holidays; and

(ii)

for an aggregate of not more than 28 other days in any calendar year or such greater number of days as the Registrar may allow in cases of emergency,or where his spouse is exempted under sub-paragraph (2), he and his spouse keep or use the vehicle in Singapore only —

(A)

on Saturdays, Sundays and public holidays; and

(B)

for a combined aggregate of not more than 28 other days in any calendar year or such greater number of days as the Registrar may allow in cases of emergency.

Subregulation 2

Suggest a correction

Where a person is exempted under sub-paragraph (1) in respect of a vehicle, his spouse shall be exempted from section 12 of the Act in respect of the vehicle during the period of validity of the approval referred to in sub-paragraph (1)(d)(i) if the following conditions are satisfied:

(a)

the spouse is a citizen or permanent resident of Singapore, and resides in Malaysia;

(b)

the person, the spouse or the person’s employer is the registered owner of the vehicle;

(c)

there is in force in respect of the vehicle a valid approval under rule 4 of the Road Traffic (Exemption from Section 12 — Approval) Rules (R 45) in relation to the use of the vehicle by the spouse.

Subregulation 3

Any woman who is a citizen of Singapore shall be exempted from section 12 of the Act in respect of any vehicle not registered under the Act, if the following conditions are satisfied:

(a)

she resides outside Singapore;

(b)

she is married to a citizen or permanent resident of Malaysia who is not also a citizen or permanent resident of Singapore;

(c)

she, her spouse or the employer of her spouse is the registered owner of the vehicle and, where the employer is the registered owner of the vehicle, the employer has provided her spouse with the vehicle;

(d)

there is in force in respect of the vehicle —

(i)

a valid approval under rule 5 of the Road Traffic (Exemption from Section 12 — Approval) Rules in relation to the use of the vehicle by her;

(ii)

a certificate of insurance which is valid for the period of validity of that approval; and

(iii)

a vehicle entry permit;

(e)

she alone drives the vehicle while the vehicle is in Singapore;

(f)

she keeps or uses the vehicle in Singapore only —

(i)

on Saturdays, Sundays and public holidays; and

(ii)

for an aggregate of not more than 28 other days in any calendar year or such greater number of days as the Registrar may allow in cases of emergency.

Any person (not being a citizen or permanent resident of Singapore) who is the holder of a work pass issued under the Employment of Foreign Manpower Act (Cap. 91A) shall be exempted from section 12 of the Act in respect of any vehicle not registered under the Act, if the following conditions are satisfied:

(a)

he resides outside Singapore;

(b)

he is the registered owner of the vehicle;

(c)

there is in force in respect of the vehicle a vehicle entry permit;

(d)

the vehicle is kept or used outside Singapore for an aggregate period of not less than 6 hours every day.

The condition mentioned in sub-paragraph (1)(d) does not apply during the period between 18 March 2020 and 30 June 2022 (both dates inclusive) in relation to the person and the vehicle mentioned in sub-paragraph (1).

Regulation 5

Exemption in respect of foreign vehicle used under general licence

Any person who is a citizen or permanent resident of Singapore, or the holder of a work pass issued under the Employment of Foreign Manpower Act (Cap. 91A), shall be exempted from section 12 of the Act in respect of any foreign vehicle used by him under a general licence on a particular occasion, if the following conditions are satisfied:

(a)

he is the holder of the general licence, or is employed by and acting under the authority of the holder of the general licence;

(b)

the Registrar has authorised him to use the general licence;

(c)

the Registrar has granted approval under rule 60A of the Road Traffic (Motor Vehicles, Registration and Licensing) Rules (R 5) for the general licence to be used upon the foreign vehicle on that occasion;

(d)

he has complied with every condition imposed by the Registrar under section 28(2) of the Act or rule 60A(3) of the Road Traffic (Motor Vehicles, Registration and Licensing) Rules;

(e)

there is in force in respect of the foreign vehicle —

(i)

a certificate of insurance which is valid for the entire period during which the foreign vehicle is used in Singapore, whether by him or by any other person, under the general licence; and

(ii)

a vehicle entry permit or a visitor’s licence issued under rule 57 of the Road Traffic (Motor Vehicles, Registration and Licensing) Rules; and

(f)

the Registrar has not suspended or revoked the general licence.
