Parking Places Rules

The Superintendent may place or erect at or near the entrance of any parking place a parking sign in accordance with any of the diagrams set out in the Schedule for the purpose of indicating that such parking place is a parking place provided under section 4 of the Act.

No person shall place or erect any sign for the parking of any vehicle at any parking place without the prior written consent of the Superintendent.

All plans designating parking places shall be approved by the Superintendent and shall be available for inspection by the public free of charge during normal office hours at the office of the Deputy Superintendent of Car Parks (Housing and Development Board) or at the office of the Deputy Superintendent of Car Parks (Urban Redevelopment Authority).

The list of roads approved by the Superintendent for the parking of vehicles shall be available for inspection by the public free of charge during normal office hours at the office of the Deputy Superintendent of Car Parks (Urban Redevelopment Authority).

No person shall make use of a parking place for any purpose other than for the parking of vehicles without the prior written consent of the Superintendent.

The Superintendent may allow any person to use a parking place for any purpose other than for the parking of vehicles on such conditions and on payment of such charges as may be determined by the Superintendent.

No person shall obstruct or cause any obstruction to a parking place or any parking lot with any vehicle, material or object.

The Superintendent may remove the vehicle, material or object which is the cause of obstruction and may detain the vehicle, material or object and any such vehicle, material or object shall remain at the risk of the owner and the person offending until all the fines, charges and expenses payable under these Rules have been paid.

The owner of any vehicle, material or object removed and detained by the Superintendent under paragraph (4) may within 30 days of such removal and detention claim from the Superintendent possession thereof upon payment to the Superintendent of the cost of the removal and the detention thereof and any other charges payable under these Rules.

Where any material or object removed by the Superintendent is of a perishable nature or where any vehicle, material or object removed by the Superintendent is not claimed by the owner within 30 days of its removal, the Superintendent may dispose of the vehicle, material or object by public auction or otherwise and may apply the proceeds of sale thereof in payment of the charges referred to in paragraph (5).

Any person using a parking place during the times specified on the signs for the parking of any vehicle shall pay the parking charge at the payment station at that parking place or through any other mode of payment provided at the parking place immediately prior to the removal of his vehicle from that parking place.

Where a person using a parking place is required to obtain a parking ticket prior to the entry of his vehicle into such parking place, that person shall surrender the parking ticket to the parking warden on duty immediately prior to the removal of his vehicle from such parking place.

Any person who fails to surrender the parking ticket to the parking warden on duty at such parking place or at the payment station in accordance with paragraph (1) shall pay to the parking warden on duty a charge equivalent to the charge for a whole day’s parking for each day or part thereof the vehicle remained at that parking place immediately prior to the removal of his vehicle from that parking place.

The Superintendent may waive or reduce the charge payable by any person under paragraph (2) if it is shown to his satisfaction that the failure to comply with paragraph (1) is not due to any negligence or fault on the part of such person.

No person shall park any vehicle in any parking place which is not specially designated for the use of that class of vehicle, unless otherwise approved by the Superintendent.

Paragraph (1) shall not apply to any motor lorry the driver of which is authorised to park for the purpose of immediately loading or unloading of goods on payment of the parking charges for the number of parking lots occupied by the motor lorry.

No person shall park any motor lorry in a parking place outside the operational hours of any parking place without the prior approval of the Superintendent.

No vehicle shall be drawn, driven, pushed or parked within a parking place otherwise than in an orderly manner and with due regard to the safety of other vehicles, property and persons within the parking place.

No unauthorised person shall push or remove any vehicle parked in any parking place without the permission of the owner or the driver of the vehicle.

No person shall park any vehicle in any parallel parking lot in any road except in the same direction as the traffic may lawfully move.

In this rule, “parallel parking lot” means a parking lot in a parking place, which is part of a road, marked out for the parking of a vehicle parallel with and close to the edge of the roadway.

Any person driving or parking a vehicle within a parking place shall obey all the signs exhibited in the parking place.

The driver of a vehicle which causes damage to any sign or property belonging to the Government, the Authority or any other statutory body in any parking place shall make good the damaged sign or property to the Government, the Authority or the statutory body, as the case may be.

In this rule, the word “sign” includes all signals, warning signs, direction signs or other devices displayed or indicated for the guidance or direction of persons driving vehicles within a parking place.

A driver of a motor vehicle must not, without authority of the Superintendent, drive the motor vehicle —

Paragraph (1) does not apply to a parking place if a flood, fire or emergency occurs in the parking place and the persons or motor vehicles in the parking place have to be evacuated.

Any person using a parking place for the parking of any vehicle shall obey all lawful directions given to him by any parking warden on duty at such parking place.

Where it appears to the parking warden on duty that any person using a parking place has in connection with such use contravened any provision under these Rules or any rules made under the Act, such person shall, if required by the parking warden, provide proof of his identity.

Any person who fails to comply with the requirements under paragraph (1) or (2) or who gives false proof of his identity shall be guilty of an offence.

No person shall park in any season parking place unless he is in possession of a season parking ticket for such parking place or is authorised by the Superintendent so to park.

Any person using a season parking place shall display the season parking ticket, which shall be visible for inspection at all times, on the front windscreen of the motor vehicle, and where the vehicle is a motor cycle the season parking ticket shall be displayed in a conspicuous position on the motor cycle.

No person shall display on a vehicle a season parking ticket that has any alteration, erasure or other irregularity therein which indicates that the season parking ticket has been tampered with.

For the purposes of these Rules, the Superintendent or any person authorised by him may require the driver of a vehicle parked in a season parking place to produce for his inspection the season parking ticket displayed on such vehicle and may retain that season parking ticket.

If the driver of such vehicle fails or refuses to produce the season parking ticket of the vehicle for inspection or retention by the Superintendent or any person authorised by him in accordance with paragraph (4), he shall be guilty of an offence.

No person shall park in any reserved parking lot unless he is authorised by the Superintendent and unless such authorisation is displayed on the front windscreen of the motor vehicle, and where the vehicle is a motor cycle, such authorisation is displayed in a conspicuous position on the motor cycle.

No person shall display on a vehicle any authorisation that has any alteration, erasure or other irregularity therein which indicates that the authorisation has been tampered with.

For the purposes of these Rules, the Superintendent or any person authorised by him may require any driver of a vehicle parked in a reserved parking place to produce for his inspection the authorisation displayed on such vehicle and may retain the authorisation.

If the driver of the vehicle fails or refuses to produce the authorisation to the Superintendent or any person authorised by him for inspection or retention in accordance with paragraph (3), he shall be guilty of an offence.

Any refund of excess payment made by the Superintendent shall be made to the person who made the payment.

If the identity of the person in paragraph (1) is unknown to the Superintendent, he may request the owner of the relevant vehicle to provide information on the identity of such person and the refund under paragraph (1) shall be made to the person identified by the owner unless the Superintendent has reason to believe he is not the person who made the payment.

The owner of the vehicle shall be guilty of an offence if he willingly provides false or misleading information under paragraph (2).
