Citation and commencement
These Regulations are the Environmental Public Health (Composition of Offences under Part IV) Regulations 2019 and come into operation on 1 April 2019.
Compoundable offences
The Director‑General, Food Administration, or an employee of the Singapore Food Agency authorised in writing by the Director‑General, Food Administration for the purpose of these Regulations, may compound any offence specified in paragraph (2), by collecting from a person reasonably suspected of having committed the offence a sum not exceeding the lower of the following:
one half of the amount of the maximum fine that is prescribed for the offence;
$5,000.
The compoundable offences are as follows:
section 32(1), 33, 34(1), 35, 36, 37(5), 38(1), 39(1) or (2), 40(1) or (9) or 41(1), read with section 41A of the Act;
section 32(2), 38(2), 39(3) or 41(2), read with section 85(1) of the Act;
any offence under the Environmental Public Health (Food Hygiene) Regulations (Rg 16).
On payment of the composition amount under paragraph (1), no further proceedings are to be taken against that person in respect of the offence.
Payment into Consolidated Fund
All sums collected under these Regulations must be paid into the Consolidated Fund.
