Citation and commencement
These Regulations are the Environmental Public Health (Specified Premises) Regulations 2021 and come into operation on 30 July 2021.
Environmental sanitation programme for specified premises
The manager of any specified premises must endorse and submit to the Director‑General the environmental sanitation programme for the specified premises mentioned in section 62B(2)(a) of the Act —
in the manner that the Director‑General requires; and
within the applicable period mentioned in paragraph (2) or such longer period as the Director‑General may allow in any particular case.
For the purposes of paragraph (1), the applicable period for any specified premises is —
in the case of a developed environmental sanitation programme mentioned in section 62B(1)(a) of the Act for the specified premises — one month after the date on which the premises become specified premises; or
in the case of an amended or updated environmental sanitation programme mentioned in section 62B(1)(b) or (c) (respectively) of the Act for the specified premises — 14 days after the date on which the environmental sanitation programme is amended or updated.
The manager of any specified premises must —
keep at the specified premises a copy of the environmental sanitation programme for the specified premises that is up‑to‑date; and
make that copy available for inspection if required by the Director‑General or any authorised officer appointed under section 3(2) of the Act.
Any person that contravenes paragraph (3) shall be guilty of an offence and shall be liable on conviction —
for a first offence, to a fine not exceeding $5,000; and
for a second or subsequent offence, to a fine not exceeding $10,000.
Replacement of Environmental Control Coordinator or Environmental Control Officer
If the appointment of the Environmental Control Coordinator or Environmental Control Officer (as the case may be) for any specified premises is terminated, or the registration of the Environmental Control Coordinator or Environmental Control Officer (as the case may be) for any specified premises is suspended or cancelled under section 61A(3) of the Act, the manager of the specified premises must, within the applicable period mentioned in paragraph (2), or such longer period as the Director‑General may allow in any particular case —
appoint another registered Environmental Control Coordinator or registered Environmental Control Officer (as the case may be) as the new Environmental Control Coordinator or Environmental Control Officer (as the case may be) for the specified premises; and
endorse and submit to the Director‑General, in accordance with regulation 2(1), the environmental sanitation programme for the specified premises that is updated with the particulars of the new Environmental Control Coordinator or Environmental Control Officer (as the case may be) appointed under sub‑paragraph (a).
For the purposes of paragraph (1), the applicable period for any specified premises is —
where the appointment of the Environmental Control Coordinator or Environmental Control Officer (as the case may be) for the specified premises is terminated — 14 days after the termination of the appointment; or
where the registration of the Environmental Control Coordinator or Environmental Control Officer (as the case may be) for the specified premises is suspended or cancelled under section 61A(3) of the Act — 14 days after the suspension or cancellation (as the case may be) of the registration.
Any person that contravenes paragraph (1) shall be guilty of an offence and shall be liable on conviction —
for a first offence, to a fine not exceeding $5,000; and
for a second or subsequent offence, to a fine not exceeding $10,000.
Other duties of manager of specified premises
The manager of any specified premises must —
provide the Environmental Control Coordinator or Environmental Control Officer (as the case may be) for the specified premises with the facilities, equipment and information that are necessary to enable the Environmental Control Coordinator or Environmental Control Officer to discharge his or her duties effectively; (b)permit the Environmental Control Coordinator or Environmental Control Officer (as the case may be) for the specified premises to attend the meetings and training courses relating to the work of the Environmental Control Coordinator or Environmental Control Officer that the Director‑General may require; (c)reimburse the Environmental Control Coordinator or Environmental Control Officer (as the case may be) for the specified premises for all expenses incurred by the Environmental Control Coordinator or Environmental Control Officer in attending the meetings or training courses mentioned in sub‑paragraph (b); and (d)not make any deduction from the remuneration of the Environmental Control Coordinator or Environmental Control Officer (as the case may be) for the specified premises for being absent from work for the purposes of attending the meetings or training courses mentioned in sub‑paragraph (b).
Any person that contravenes paragraph (1) shall be guilty of an offence and shall be liable on conviction —
for a first offence, to a fine not exceeding $1,000; and
for a second or subsequent offence, to a fine not exceeding $2,000.
