Citation and commencement
These Regulations are the Tobacco and Vaporisers Control (Hair Specimens and Hair Tests) Regulations 2026 and come into operation on 1 May 2026.
Definition
In these Regulations, “enforcement officer” means —
an authorised officer appointed under section 19 of the Act; or
a supervising officer appointed under section 19A(2) of the Act.
Collection of hair specimens
Every person who is required to provide his or her hair specimens for hair tests under section 19K or 19R(5)(b) of the Act (called in these Regulations a subject), and every enforcement officer who collects the hair specimens, must do so in accordance with the Schedule.
Hair test
Where a subject’s hair specimens are sent to the Health Sciences Authority for a hair test, the Chief Executive must arrange for the hair specimens to be tested.
The results of the hair test mentioned in paragraph (1) must be sent to the enforcement officer in charge of the subject’s case.
