Regulation 45
Channels, fairways and prohibited anchorage areas
Subregulation 1
The channels, fairways and prohibited anchorage areas are specified in the Third Schedule.
Subregulation 2
The Port Master may at any time by notice restrict or prohibit the movement of a vessel or class of vessels in the port but the notice must state the period of the prohibition, the area to which it is applicable, the nature of the prohibition and whether the prohibition relates to anchorage or passage or such other purposes as he may require.
Subregulation 3
The owner, agent, master or person-in-charge of a vessel —
which uses that part of the sea in any of the areas referred to in paragraph (1) contrary to any restriction or prohibition imposed by these Regulations or by the Port Master; (aa)which anchors within the prohibited anchorage area specified in paragraph 1.2 of the Third Schedule; or
which is in breach of any restriction or prohibition imposed by the Port Master in paragraph (2),shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $20,000 and, in the case of a continuing offence, to a further fine not exceeding $2,000 for every day or part of a day during which the offence continues after conviction.
